GENERAL

  • By commissioning me, you agree that you read and accepted all the following conditions.

  • I create all works in my style

  • I can reject an order without giving reasons

  • If an order is more complex than normal, I am entitled to adjust the price for the additional effort

  • All drawings will include a „Promo“ version for Social Media posts that include subtle watermarks and signature that you may not remove

  • I might stream and record the drawing process

  • Do not request a commission if you’re not comfortable or don’t agree to my T.O.S

  • It is absolutely prohibited to use my art for AI and NFT purposes

  • You cannot claim my work as your own

  • You are NOT authorised to edit my works without my permission

  • You are NOT authorised to trace over my Artwork in any way, including the use of the artwork as a “base”

ORDER, PAYMENTS & REFUNDS

  • Both parties can cancel the order, but refund depends how much work was done.

  • Completed orders are non-refundable

  • Please be as concise as possible in your commission request. I am not responsible for any mistakes on your end.

  • You are responsible for making currency conversions.

  • I will start the commission only once I receive at least 50% of the price upfront. 100% of the payment is preferred however

  • If you order a commission and take longer than 10 days to pay without replying to me, your order will be cancelled and you will lose your slot.

  • I can refund 100% of the payment only if the commission has not been started yet.

  • Once I start the sketch, your commission can not be refunded anymore.

  • If I cancel a project, I will refund 100% of the payment.

  • If we agree on a payment plan and I start the commission after the first deposit has been done, I will not refund your said deposit if you back out of the Payment Plan.

REVISIONS

  • Changes can be made free of charge at any time during the sketch phase

  • Color changes can be made at any time free of charge

  • Changes to the pose or figure will be subject to a charge after the outlines have been completed

SCHEDULE / QUEUE

  • I usually take 1-3 days to respond to your initial order inquiry

  • My commissions usually take 1-2 months (depends on the commission type and amount of details). This may be due to the waiting list or the complexity of the order

  • I will always keep you up to date and inform you about the current status

  • I may decline your commission if I think the deadline is too tight

  • I will update you anytime I have something news or relevant to show

  • You have the right to ask for updates and to be notified if there are any delays

  • Please, do not rush me. Any harassment will result in having you blacklisted

  • Once I receive the payment, I will begin working on your commission and keep you updated on the progress and the estimated timeline.

USE

  • Commissions are intended for personal use only.

  • Commercial use can be purchased for an additional charge depends on the commision between 30% to 50%

  • I retain all rights to my work and can include it in my portfolio and share it on my social media

  • Any commissioned work is for personal use unless otherwise stated. Credits must be given always if you decide to post my commission.

  • You must tell me beforehand if your commission has a deadline. If you decide to commission me, mention a deadline after and refuse to pay for the deadline commission, you may be added to a blacklist.

INTELLECTUAL PROPERTY RIGHTS

  1. Copyright:

    As the creator of a work, I automatically hold the copyright to it. This means that I have the right to decide how my work is used and distributed. Even if I sell my work or grant a license, I remain the owner of the copyright.

  2. Usage Rights:

    When someone acquires my work, they typically only receive the usage rights. These rights specify how the work may be used, for example, for personal use or for commercial purposes. I define the rights and restrictions regarding how the work may be used.

  3. Commercial Use:

    If my work is to be used for commercial purposes, such as for advertising, merchandise, or sales, I require an additional fee or license. The amount of this fee depends on how the work will be used and to what extent.

  4. Editing Rights:

    I have the right to decide if and to what extent my work may be edited or modified. If someone wishes to edit my work, they must obtain my consent. This also applies to using my work as a “base” for other creations.

  5. Publication and Distribution:

    I decide when and how my work is published or distributed. This means I determine whether and how my work is shown on social media, in galleries, or other public spaces.

  6. Intellectual Property Protection:

    It is important for me to protect my intellectual property to prevent unauthorized use of my work. This can be achieved through copyright registration, watermarks, or contractual agreements.

  7. License Agreements:

    When I grant someone the right to use my work, I create a license agreement. This agreement specifies how and under what conditions the work can be used, such as the duration, location, or specific purpose.

  8. Intellectual Property Infringement:

    If someone uses my work without permission, I have the right to take legal action. I can pursue violations to protect my rights and ensure my work is not used unlawfully.

  9. Moral Rights:

    As the creator, I also have moral rights to my work. This means I can ensure I am recognized as the creator and take action against distortions or inappropriate modifications of my work that contradict my creative vision.

  10. Copyright Societies:

    If I protect my rights through a copyright society like GEMA (in Germany), they ensure that I am compensated for the use of my works. They collect licensing fees and help enforce my intellectual property rights.

  11. Public Use with Credit to Me:

    Users are allowed to publicly post my work, whether on social media or other platforms, but only if they clearly and visibly credit me as the creator. This ensures my rights as the creator are recognized and protects the integrity of my work.

It is important to me that these points are clearly defined when I sell or license my works, in order to avoid misunderstandings or legal conflicts.

  • TAT (turn-around-time) may change depending on the commission type (VTuber models and reference sheets may take longer). The general TAT is 1 to 5 months.

  • Canvas Size for VTuber models is 8000x5000px 400dpi (could be higher)
